Reading your Terms of Service, I noticed that they include a Data Processing Agreement (DPA) with an annex of Standard Contractual Clauses (SCCs) to cover international data transfers from Europe.
However, the SCCs are the version of 2010, which is deprecated. Since September 2021, DPAs may only use the 2021-version of the SCCs (see European Commission Implementing Decision (EU) 2021/914 of 4 June 2021).
Could you provide a version of the ToS that includes the new SCCs? Could you please also provide the assessment required under Clause 14 (b)+(d) of the new SCCs?
